The Swedish Land and Environmental Court of Appeal has today announced its rejection of Nordkalk’s permit application including conditions for the planned limestone quarry Bunge Ducker 1:64 on Northern Gotland. Nordkalk received a permit including conditions for the operations in 2014, but since the Swedish government decided to protect the area as a Natura 2000 area before the permit gained legal force, the preconditions have now changed.
The Court has based its deliberations on the new conditions resulting from the Swedish government’s decision on Natura 2000. Since a large part of the natural habitat Karst, that the government wanted to protect, is within the extraction area, the Court finds that the operations cannot be carried out without harming the natural habitat. The Court also rejects Nordkalk’s petition to seek a preliminary ruling from the Court of Justice of the EU.
- We are of course disappointed, since we already have received a permit on two earlier occasions - a permit that could have been confirmed now, if it wasn’t for the government’s Natura 2000 decision. The fact that the government intervenes in an ongoing permit process and changes the preconditions so radically as in this case, and in favour of the state, is not legally secure. A private business’s basic legal rights must be taken care of and protected, says Håkan Pihl, Chief Geologist at Nordkalk.
- Even though the process has been going on for over 12 years, Nordkalk will take the matter further, first to the Supreme Court, but if needed also to the European Court of Human Rights. It is important that the Bunge case will be tried all the way, not only for our own but for the whole industry’s sake, he concludes.
